Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

According to a widely shared interpretation, research employing spontaneous-response false belief tasks demonstrates that infants as young as 15 months attribute (false) beliefs. In contrast with this conclusion, I advance an alternative reading of the empirical data. I argue that infants constantly form and update their expectations about others’ behaviour and that this ability extends in the course of development to reflect an appreciation of what others can and cannot see. These basic capacities account for infants’ performance in spontaneous-response false (...) belief tasks without the need to assume the existence of a cognitive module specific for mental state attribution. My proposal suggests a plausible explanatory strategy for the problem of the representational format of the information processed in spontaneous-response false belief tasks. (shrink)

I discuss three arguments that have been advanced in support of the epistemic mentalist view, i.e., the view that infants' social cognitive abilities manifest a capacity to attribute beliefs. The argument from implicitness holds that SCAs already reflect the possession of an “implicit” and “rudimentary” capacity to attribute representational states. Against it, I note that SCAs are significantly limited, and have likely evolved to respond to contextual information in situated interaction with others. I challenge the argument from parsimony by claiming (...) that parsimony per se favors neither a mentalist nor a behavior-reading account. Finally, I argue that early SCAs do not develop continuously into four-year-olds' belief attribution abilities. Accordingly, the argument from developmental continuity is empirically inadequate. Careful analysis of both the empirical data and the theoretical assumptions leading to the epistemic mentalist view is needed in order to improve our understanding of SCAs in earl.. (shrink)

Since Darwin proposed that human musicality evolved through sexual selection, empirical evidence has supported intersexual selection as one of the adaptive functions of artistic propensities. However, intrasexual competition has been overlooked. We tested their relative importance by investigating the relationship between the self-perceived talent/expertise in 16 artistic and 2 sports modalities and proxies of intersexual selection and intrasexual competition in heterosexuals. Participants were 82 Brazilian men, 166 Brazilian women, 146 Czech men, and 458 Czech women. Factor analysis revealed five factors: (...) Literary-arts, Visual-arts, Musical-arts, Circus-arts, and Sports. Multivariate General Linear Model showed more associations of the arts to intersexual selection in women and to intrasexual selection in men, and overall more relationships in women than in men. In women, literary and musical-arts were related to elevated inter- and intrasexual selections proxies, visual and circus-arts were related to elevated intersexual selection proxies, and sports were related to intrasexual selection proxies. In men, literary-arts and sports were related to elevated inter- and intrasexual selection proxies, musical-arts were related to intrasexual proxies, and circus-arts were related to intersexual proxies; visual-arts did not have predictors. Although present in both sexes, each sexual selection component has different relative importance in each sex. The aim of this dissertation is to provide an analysis of central concepts in philosophy of science from the perspective of current molecular and developmental research. Each chapter explores the ways in which particular phenomena or discoveries in molecular biology influences our philosophical understanding of the nature of scientific knowledge. The introductory prologue draws some general connections between the various threads, which revolve around two central themes: causation and explanation. Chapter Two identifies a particular type of causal relation which is (...) widespread across the sciences, but cannot be straightforwardly accommodated by extant accounts of causation and causal explanation. Chapter Three explores how the form of redundant causality identified in the previous chapter plays an important role in causal explanation, by making the effect stable and robust. Chapter Four offers a novel perspective on the debate over biological reductionism by distinguishing between different paradigms of molecular explanation. Chapter Five provides a philosophical analysis of the so-called "Developmental Synthesis" of evolutionary and developmental biology, and suggests a general account of scientific unification grounded in the notion of explanatory relevance. Chapter Six offers an account of dispositional properties inspired by mechanisms of gene regulation, according to which dispositions are not properties of entities, but properties that describe the behavior of abstract idealized models. Finally, Chapter Seven scrutinizes the concept of the molecular ecosystem, a metaphor frequently employed by biologists to describe cellular interactions, but seldom articulated in detail. (shrink)

Communities most vulnerable to the effects of climate change, such as reduced access to material resources and increased exposure to adverse weather conditions, are intimately tied to a considerable amount of cultural and biological diversity on our planet. Much of that diversity is bound up in the social practices of Indigenous groups, which is why these practices have great long-term value. Yet, little attention has been given to them by philosophers. Also neglected have been the historical conditions and contemporary realities (...) that constrain these practices and devalue the knowledge of their practitioners. In this essay, we make the case for preserving a diverse range of social practices worldwide, and we argue that this is possible only by strengthening the communities of practitioners who enact them in the contexts in which they are adaptive. By concentrating on Indigenous communities, we show how focusing on practices can transform how Indigenous and other local communities are represented in global climate-change conversations and policy as a matter of justice. More specifically, we argue that practice-centered thinking and local practices provide critical insights for determining the extent to which climate policies protect and enable transformative change. In this article, Charlotte Blease argues that patient access to online shared clinical notes (also called ‘open notes’) may cause or exacerbate nocebo effects in two ways. 1 First, open notes may enhance patient understanding about the adverse effects of medications and treatments. However, reading information about adverse effects may lead patients to form negative expectations that, in turn, may cause or worsen symptoms via nocebo mechanisms. Second, open notes may paradoxically lower the quality of the therapeutic relationship by allowing (...) patients to detect signs of discrimination and stigma in clinical notes. By accessing their shared notes, patients may identify (or think that they are identifying) signs of stigmatisation and discrimination in clinicians’ words. This may diminish their trust while increasing their anxieties and fears, all factors that have been associated with enhanced nocebo effects. We study a principle of ‘Non-Interference’ in social welfare judgements. Non-Interference captures aspects of liberal approaches (particularly a Millian approach) to social decision making. In its full generality, Non-Interference produces an impossibility result: together with Weak Pareto Optimality, it implies that a social welfare ordering must be dictatorial. However, interesting restricted versions of Non-Interference are compatible with standard social welfare orderings.

In discussions on moral responsibility for actions, a commonly discussed case is one in which an agent is manipulated into performing some action. On some views, such agents lack responsibility for those actions partly because they issue from attitudes that were acquired in an inappropriate way. In this paper, it is argued that such views are in need of revision. After introducing a new problematic case of a manipulated agent, revisions are offered for specific views. The distinction between nature and artifice has been definitive for Western conceptions of the role of humans within their natural environment. But the human must already be separated from nature in order to distinguish between nature and artifice. This separation, in turn, facilitates a classification of knowledge in general, typically cast in terms of a hierarchy of sciences that ascends from the natural sciences to the social (or human) sciences. However, this hierarchy considers nature as a substantial foundation upon which (...) artifice operates and to which it responds. Here I examine three inter-related concepts that, by focusing on events rather than substances, operate beyond the nature–artifice distinction and thereby resist the hierarchical classification of the sciences: Foucault’s concept of technology, the concept of milieu as it crosses over historically from physics to biology and anthropology, and Deleuze and Guattari’s reconfiguration of the concept of milieu in terms of their concept of machine. We investigated motor resonance in children using a priming paradigm. Participants were asked to judge the weight of an object shortly primed by a hand in an action-related posture or a non action-related one . The hand prime could belong to a child or to an adult. We found faster response times when the object was preceded by a grasp hand posture . More crucially, participants were faster when the prime was a child’s hand, suggesting that it could belong to (...) their body schema, particularly when the child’s hand was followed by a light object . A control experiment helped us to clarify the role of the hand prime. To our knowledge this is the first behavioral evidence of motor simulation and motor resonance in children. Implications of the results for the development of the sense of body ownership and for conceptual development are discussed. (shrink)

This novel contributed volume advances the current debate on free will by bridging the divide between analytic and historically oriented approaches to the problem. With thirteen chapters by leading academics in the field, the volume is divided into three parts: free will and determinism, free will and indeterminism, and free will and moral responsibility. The contributors aim to initiate a philosophical discourse that profits from a combination of the two approaches. On the one hand, the analytic tools familiar from the (...) debate – arguments, concepts, and distinctions – can be used to sharpen our understanding of classical philosophical positions. On the other hand, the rich philosophical tradition can be reconstructed so as to inspire new solutions. The concepts and powerful mathematical tools of Dynamical Systems Theory (DST) yield illuminating methods of studying cognitive processes, and are even claimed by some to enable us to bridge the notorious explanatory gap separating mind and matter. This article includes an analysis of some of the conceptual and empirical progress Dynamical Systems Theory is claimed to accomodate. While sympathetic to the dynamicist program in principle, this article will attempt to formulate a series of problems the proponents of the approach in (...) question will need to face if they wish to prolong their optimism. The main points to be addressed involve the reductive tendencies inherent in Dynamical Systems Theory, its somewhat muddled position relative to connectionism, the metaphorical nature DST-C exhibits which hinders its explanatory potential, and DST-C's problematic account of causality. Brief discussions of the mathematical and philosophical backgrounds of DST, seminal experimental work and possible adaptations of the theory or alternative suggestions (dynamicist connectionism, neurophenomenology, R&D theory) are included. I begin by briefly reconstructing Honneth’s concept of reification. His paradigm gives the reification of the non-human environment a marginal position in comparison to the reification of human beings, thereby detracting from its explanatory and critical potential. In order to avoid this outcome, I subsequently present a paradigm of subject identity formation in which not only affectively-based intersubjective interactions but also affectively-based interactions with the non-human environment are, in both a “genetic” and a “conceptual” sense, essential to establish an objective (...) and meaningful relationship with external reality. On the basis of this paradigm a closer connection can be identified between the reification of human beings and the reification of the non-human environment—a connection in which the reification of the latter may reinforce human reification (and vice versa). Discussions about the merits and shortcomings of non-inferiority trials are becoming increasingly common in the medical community and among regulatory agencies. However, criticisms targeting the ethical standing of non-inferiority trials have often been mistargeted. In this article we review the ethical standing of trials of non-inferiority. In the first part of the article, we outline a consequentialist position according to which clinical trials are best conceived as epistemic tools aimed at fostering the proper ends of medicine. According to this view, (...) clinical trials are means to ends, and thus their moral status depends both on how well they perform as means to reach desired ends and on which ends they are meant to achieve. Building upon this normative framework in the next two sections we analyze the specific ethical issues raised by non-inferiority trials. By making it clear that clinical trials are just epistemic tools – i.e. means to certain ends – it is possible not only to clarify the conceptual debate over a fundamental issue in clinical research, but also to identify which ethically relevant considerations ought to be addressed in setting up a non-inferiority trial. Over three decades, Axel Honneth has developed one of the most fully-structured recognition paradigms in the field of social philosophy. Although it has undergone considerable theoretical changes, this paradigm retains a strong unity. I will analyze it in light of the Frankfurt school critical social theory research program. By so doing, I aim, first, to outline a defense of Honneth’s theory against growing criticisms, which tend to see depletion of its critical insights in his most recent works. Secondly, I aim (...) to highlight that most of the weaknesses pointed out by his critics derive from the methodology with which Honneth frames the concept of recognition, and which he explicitly related to the Frankfurt school critical social theory. Thirdly, I argue that, insofar as we are at present witnessing a transformation in the nature of current struggles for recognition, it is precisely one of the premises of this methodology that runs the risk of being undermined (i.e. the classical relation between theory and “praxis”). By using algebraic properties of (commutative unital) indecomposable polynomial rings we achieve results concerning their first-order theory, namely: interpretability of arithmetic and a uniform proof of undecidability of their full theory, both in the language of rings without parameters. This vastly extends the scope of a method due to Raphael Robinson, which deals with a restricted class of polynomial integral domains.

The Unconscious in Neuroscience and Psychoanalysis presents a unique and provocative approach to the assimilation of these two disciplines while offering a thorough assessment of the Unconscious from a neuropsychoanalytic and Lacanian perspective. This paper proposes a new reading of Nicomachean Ethics I 2 1094a18-22 with a view to solving the problem that the argument this passage contains would be invalid because it apparently commits a quantifier shift to reach its conclusion. On the reading advocated in this paper, no fallacy is committed, and the argument is sound provided one reads the conclusion at 1094a21-22 in the way the manuscript Marcianus 213 invites us to do. Matthias Schirn has argued on a number of occasions against the interpretation of Frege's ``objects of a quite special kind'' (i.e., the objects referred to by names like `the concept F') as extensions of concepts. According to Schirn, not only are these objects not extensions, but also the idea that `the concept F' refers to objects leads to some conclusions that are counter-intuitive and incompatible with Frege's thought. In this paper, I challenge Schirn's conclusion: I want to try and argue (...) that the assumption that `the concept F' refers to the extension of F is entirely consistent with Frege's broader views on logic and language. I shall examine each of Schirn's main arguments and show that they do not support his claim. (shrink)
